The second respondent in the appeal who is the contesting party, had died and the same has been recorded by order dated 17.04.2024, wherein time has been given for taking steps.

When the matter was listed on 07.03.2025, further time was given as last opportunity for taking necessary steps to substitute the legal heirs of the deceased contesting second respondent. 3.

Today, when the matter is taken up for hearing, no steps have been taken as against the second respondent and the first respondent is only an official formal party and the appellants are not interested in prosecuting the appeal.

In view of the same, this Second Appeal is dismissed as abated. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
