O R D E R

The Contempt Petition is filed alleging that the order passed by this Court on 19.10.2023 has not been complied, despite reasonable time lapsed.

2. On perusal of the record, this Court finds that NBW was issued against the absconding accused in C.C.No.15106 of 2022 on the file of Metropolitan Magistrate, Egmore. It is a private complaint wherein, against the absconding accused, warrant was issued. In such circumstances, alleging that the police have not executed the NBW, petition under Section 482 of Cr.P.C., was filed and taken up for consideration by this Court.

3. This Court, on considering the fact that the accused is absconding and the information gathered by the police revealed that he was found in Rajasthan, directed the respondent police to take necessary steps to secure him within reasonable time.

4. Now, the Contempt Petition is filed alleging that the police have not secured the absconding accused. The status report filed by the Inspector of Police reveals that the police has gone to Rajasthan and on getting a lead that the accused was in West Bengal, they gone to Calcutta and got the assistance of Page Nos.2/5

the police in Calcultta to trace the absconding accused. However, all ended in futile. The status report discloses the genuine efforts taken by the respondent police. Therefore, this Court finds there is no wilful disobedience of the Court order.

5. In case, the complainant/petitioner want to pursue the private complaint, it is always open for him to take necessary steps to declare the absconding accused as a proclaimed offender and proceed further.

6. With the above observation, this Contempt Petition is closed. 22-06-2026 Index :Yes/No.
