2. The learned counsel appearing for the applicant/plaintiff would submit that since the respondents/defendants filed written statement with false contentions, it has become just necessary to file the additional documents relating to the amendment of Bye-laws of the society relating to the induction of the members to the society. He would also submit that since the additional documents were not available at the time of instituting the suit and later during the pendency of the suit the applicant/plaintiff obtained the same. Hence he seeks permission to file the said additional documents.
3. The learned counsel appearing for the respondents would submit that the additional documents are not necessary and the applicant/plaintiff, only with an intention to drag on the suit proceedings, has filed the same.
4. Considering the submissions made by the learned counsel appearing for the applicant/plaintiff and upon perusal of the propsed additional documents, this Court feels it appropriate to entertain the
application.
5. Accordingly, this application is allowed and the applicant/plaintiff is permitted to file the additional documents, however subject to proof and relevance of the documents.
