ORDER

Petition seeking bail in respect of Crime No.46 of 2025 registered for the offences punishable under Sections 87 of BNS (336 of IPC) and sections 5(n), 5(m) and 6 of the POCSO Act, 2012, is on board for consideration.

2. The learned counsel for the petitioner, pleading innocence on the part of the petitioner, who has been in incarceration since 29.12.2025 and false implication in the case, seeks indulgence of this Court. He further submitted that

the petitioner is the paternal uncle of the victim and pleaded that he has not committed any offence as alleged by the prosecution.

3. The case of the prosecution as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail is that the petitioner is the paternal uncle of the minor victim who is aged 17 years. He committed penetrative sexual assault on the victim. He also submitted that the minor victim girl has been secured and the statement under Section 183 of BNSS has also been recorded from her and the same has been produced before this Court.

4. Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record including the statement recorded under Section 183 of BNSS from the minor victim girl, this Court is not inclined to enlarge the petitioner on bail.

5. Accordingly, this Criminal Original Petition is dismissed. 28-04-2026 SHL
