ORDER

Petitioner has filed this writ petition, seeking for the issuance of a mandamus to direct the respondent to consider his application dated 12.12.2006 for grant of mini bus stage carriage permit between Anthiyur Bus Stand and Thoppapalayam, Erode District. 2.It is the case of the petitioner that the application filed by him for grant of mini bus permit was returned for production of solvency certificate and residential proof. Since the respondent refused to receive the application resubmitted by the petitioner, he has filed a writ petition in W.P.No.9134 of 2007, seeking a direction to the respondent to receive the application, process the same and pass orders. By order dated 13.03.2007, this Court directed the respondent to receive the application and dispose of the same within a period of twelve weeks. Pursuant to the order of this Court, the respondent received the application but has not passed any orders. 11.04.2015 and 10.08.2015 respectively. Since no action has been taken by the respondent, the petitioner has filed the present writ petition.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent. 4.Despite the direction of this Court made in W.P.No.9134 of 2007 dated 13.03.2007 to dispose of the application of the petitioner, even after a lapse of more than seven years, no orders have been passed by the respondent till date. The lethargic attitude of the respondent cannot be countenanced.

5.Today, the learned Additional Government Pleader, produced a communication from the Regional Transport Officer dated 23.09.2015, wherein it has been stated that the Government of Tamil Nadu published a new comprehensive scheme with effect from 23.02.2011. But nothing has been stated about the fate of the petitioner's application.

6.Considering the facts and circumstances of the case, the respondent is directed to consider the application of the petitioner and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
