JUDGMENT

This appeal is of the year 2001 and it was transferred to this Court from the file of the District Court, Salem, to be heard along with A.S.No.386 of 1994.

2.It is now found that A.S.No.386 of 1994 has been dismissed by this Court on 25.07.2008 on merits. The respondents have not been served.

3.Mr.R.Aravind, who is appearing for the appellant, would submit that he has not entered appearance in the transferred appeal and his name is shown as counsel for the appellant, since he has filed the transfer application in this Court. Therefore, the Appeal Suit is dismissed for default. There shall be no order as to costs.
