A.No.4934 of 2021 in C.S.o.657 of 2014 A.No.4934 of 2021 in C.S.o.657 of 2014 N.SESHASAYEE, J., The present application is filed by the 23rd defendant to condone the delay of 2397 days (approximately 6 years and 7 months) in condoning the delay in filing the written statement.

2.1 This Court has to record its utter disappointment on the way the defendant chooses to use the judicial forum. The statute has stipulated the time frame in which the written statement has to be filed, but this defendant considers that defending the suit is its last priority.

2.2 However, in view of the larger interest involved in this litigation, this Court chooses to condone the delay, but on payment of cost of Rs,36,000/- (Rupees Thirty Six Thousand only) by the applicant, of which Rs.24,000/- is directed to be paid to the counsel for the plaintiffs and the balance Rs.12,000/- to Kaingkarya Social Welfare Organisation, 2/459, 11, Kanabiran Koil Street, Thirisulam, Pallavaram, Chennai - 600 043, (Ph.No.22641945).

3. The application is allowed accordingly.
