V.Ramkumar v. The Inspector Of Police

CRL. O.P. No.17574 of 2016 S.VAIDYANATHAN, J.

Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 366, 376 and 506(i) IPC in Crime No.3 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused kidnapped the defacto complainant and took her to a remote place and the accused had forceful physical relationship with her. The further allegation is that when the defacto complainant along with her mother went and asked the accused, they threatened them.

3. Learned Government Advocate (Crl.

Side) submitted that the petitioner has committed very serious offence and if the petitioner is released on anticipatory bail, he will tamper the witnesses and hence, opposed for grant of anticipatory bail to the petitioner.

4. Learned counsel for the petitioner submitted that the petitioner has not committed any such offence and he has been falsely implicated in this case.

5. Considering the serious allegations against the petitioner, this Court is not inclined to grant the relief sought for by the petitioner and this petition is dismissed.
