Respondents Prayer: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the 3rd respondent not to harass the petitioner on the basis of the complaint of the de facto complainant namely, Baskaran @ Narasiman.

ORDER

This Criminal Original Petition has been filed seeking a direction to the 3rd respondent not to harass the petitioner on the basis of the complaint of the de facto complainant namely, Baskaran @ Narasiman.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a complaint given by one Baskar alias Narasiman, petition enquiry is pending before the third respondent. Under such circumstances, blanket order of 'not to harass' cannot be passed. The petitioner shall co-operate for the enquiry and during the course of enquiry, he shall not be harassed. However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused.

With the above observation, the Criminal Original Petition is disposed of.
