W.M.P.No.14526 of 2022 W.M.P.No.14526 of 2022 in Rev.Aplw.Sr.No.45706 of 2022 in W.P.No.9000 of 2020 M.DHANDAPANI , J., The Writ Petition has been filed by the Petitioner before this Court for restraining the respondents from putting up any overhead tank in the common pathway which is being utilized by the petitioner. 2.When the matter is taken up for hearing on 25.01.2022, a memo has been filed on behalf of the Government stating that neither any overhead tank is constructed nor is there any proposal to construct an overhead tank in the place mentioned by the petitioner. Recording the same, the Writ Petition is closed.

3. Hence, the petitioner filed Review Application and Petition to condone delay of 25 days in filing the Review Petition. This Court ordered notice to the respondents and thereafter adjourned to 05.09.2022, for filing Affidavit of Service. Till date Affidavit of Service is not filed. https://www.mhc.tn.gov.in/judis 1/2

Even on perusal of order, makes it clear that Petitioner submits that respondents are going to construct an overhead tank, whereas, the respondents categorically stated that there is no proposal to construct an overhead tank in the petitioner disputed property. Hence, the review application certainly only error on the face of the records or clerical error. In the present case, there is no situation arises for reviewing the order. Hence, this Writ Miscellaneous Petition is dismissed. No costs.
