Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, to direct the respondents to consider petitioner's representation dated 26.09.2017 and transfer the petitioner from Thiruvannamalai Government Medical College Hospital, Thiruvannamalai District to Government Hospital, Alangulam, Tirunelveli District or Government Sidha Medical College Hospital or to any one Government Hospital or to any one Urban Primary Health Centre, Tirunelveli District, which is nearest to the petitioner's native place.

ORDER

The petitioner was appointed as a Staff Nurse by the second and third respondents on 28.8.2006 at Government Primary Health Centre, Elanthakuttai, Namakkal District. After regularisation of her services, the Director of Medical and Rural Health Services, Chennai, the second respondent herein posted her as Staff Nurse at Thiruvarur Government Medical College Hospital on 7.7.2010. Subsequently, she married one Mr.N.Chinnavar in the year 2010, who is also working and living at Tirunelveli with her in-laws. As she is now working in https://hcservices.ecourts.gov.in/hcservices/

Thiruvannamalai Government Medical College Hospital which is about 650 Kms., away from Tirunelveli, the petitioner is separately living from her husband, children and family. Learned counsel for the petitioner, after obtaining information under the Right to Information Act on 7.8.17 with regard to the availability of vacancies for the post of Staff Nurse in Tirunelveli, submitted that there are two vacancies available. In view of the long separation of the petitioner from her family, she has given a representation on 26.9.2017 to the respondents to post her to any one of the Government Hospitals at Tirunelveli. But the said representation, till date, has not been considered. Therefore, a direction may be issued, he pleaded.

2. Mr.R.A.S.Senthilvel, learned Additional Government Pleader takes notice on behalf of the respondents.

3. In the light of the above, the respondents are hereby directed to consider the case of the petitioner, as she is living away from Tirunelveli from her husband, children and family for more than ten years, while filling up of the said vacancies at Tirunelveli, and dispose of her representation. With this observation, the writ petition stands disposed of. No costs.
