O R D E R

The petitioner seeks for a direction upon the learned Principal District and Sessions Judge, Thiruvallur District, to consider his bail application on the same day in the event of his surrender in connection with a case in Crime No.63 of 2015, pending on the file of the respondent/Police. 2.

The petitioner is an accused for offence punishable under Sections 9, 16, 17 and 18 of Bonded Labour System (Abolition) Act, 1976, Sections 374, 341, 509 IPC and for offence under Section 3

(1) (vi) and 3(1) (xv) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act,1989.

The submissions made by the learned counsel appearing for petitioner and learned Additional Public Prosecutor, representing the respondents were heard. The materials available on record were also perused.

Considering the nature of offences alleged against the petitioner, the fact that anticipatory bail cannot be granted in respect of offences punishable under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, and that taking https://hcservices.ecourts.gov.in/hcservices/

into custody of the petitioner, pending consideration of his bail application could cause him irreparable hardship, this Court considers it appropriate to direct the learned Principal District and Sessions Judge, Thiruvallur District, to consider the bail application of the petitioner on merits and pass appropriate orders on the same day of his surrender.
