O R D E R

This writ petition has been filed to direct the first respondent to pass suitable orders under section 80(8) of Tamil Nadu Cooperative societies Act to order reaudit into the Chennai Metropolitan Cooperative Housing Society for the year 2020-2021 and 2021-2022 by considering the petitioner's petition dated 24.03.2025 and pass such further other orders.

2. The petitioner was former elected President of the first respondent society. The audit was conducted by the Assistant Director of Audit for the year 2020-2021 and 2021-2022 and the same was submitted to the society on 15.03.2024 and 31.01.2025 respectively. The auditor has noted certain defects for all transaction of the society from 2018-2023. The defects were noted without assigning any reasons. 2/7

The petitioner came to the knowledge of the defects in the audit report only on 21.03.2025, when the copies of the audit report was furnished to the petitioner and members of the former elected board. The petitioner submitted a petition dated 24.03.2025 to the first respondent requesting him to reaudit under section 80(8) of the Tamil Nadu Cooperative Societies Act. But the first respondent has not passed any orders on the representation of the petitioner dated 24.03.2025. Hence, the petitioner filed the present writ petition.

3. The learned Special Government Pleader appearing for the respondents would submit that the representation of the petitioner dated 24.03.2025 was received only on 03.04.2025 and the same will be considered on merits and in accordance with law within the time frame stipulated by this Court.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

This Court directs the first respondent to consider the representation of the petitioner dated 24.03.2025 by conducting detailed enquiry, after giving due notice to the petitioner, opportunity of personal hearing, to consider the documents filed by the petitioner on merits, in accordance with law, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

7. This writ petition is disposed of, with the above observations and directions. No costs.
