praying for issuance of a Writ of Mandamus, directing the 1st respondent to grant / issue a Trade Licence to the business of the petitioner in the name and style of 'Blue Ocean Spa' at No.B5, Sam Noah Tower, 1st Floor, 2nd Avenue, Anna Nagar West, Chennai - 600 102 on the petitioner's applications dated 01.12.2023 & 13.02.2024 and forbearing the respondents No.2 to 4 or their men, agents or any persons claiming under them from interfering with the peaceful conduct of the business of the petitioner in the name and style of 'Blue Ocean Spa' at No.B5, Sam Noah Tower, 1st Floor, 2nd Avenue, Anna Nagar West, Chennai - 600 102. ORDER
The present writ petition is filed for the following relief. "for issuance of a direction to the 1st respondent to grant / issue a Trade Licence to the business of the petitioner in the name and style of 'Blue Ocean Spa' at No.B5, Sam Noah Tower, 1st Floor, 2nd Avenue, Anna Nagar West, Chennai - 600 102 on the petitioner's applications dated 01.12.2023 & 13.02.2024 and forbearing the respondents No.2 to 4 or their men, agents or any persons claiming under them from interfering with the peaceful conduct of the business of the petitioner in the name
and style of 'Blue Ocean Spa' at No.B5, Sam Noah Tower, 1st Floor, 2nd Avenue, Anna Nagar West, Chennai - 600 102."
2. Mr.Habeeb Rahman, learned Government Advocate takes notice on behalf of 1st respondent and Mr.R.Kishore Kumar, learned Government Advocate (Crl. Side) takes notice on behalf of respondents 2 to 4.
3. It is the contention of the petitioner that though she has complied with all the requirements as set out by the respondents herein, the 1st respondent is not issuing the Trade Licence and therefore, she is unable to peacefully carry on her business.
4. Considering the limited prayer sought for and after hearing the learned Government Advocate, a direction is issued to the 1st respondent to consider the petitioner's applications for Trade Licence dated 01.12.2023 and 13.02.2024 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order and issue Trade Licence if the petitioner has complied with all the
requirements. It is needless to state that keeping in view the earlier orders of this Court, the respondents shall not disturb the business of the petitioner.
5. With the above directions, the writ petition stands disposed of. No Costs. Consequently, the connected Writ Miscellaneous Petition is closed. 15.05.2024 ars Index : Yes / No Speaking / Non-Speaking Order To
