O R D E R

This Writ Petition is filed for a Mandamus directing the respondents to remove the transformers erected in Old S.No.190/2, New Survey No.190/2B measuring an extent of 40 cents in Chennappanayakkanpalayam Village, Cuddalore Taluk, Cuddalore District, within a time fixed by this Court.

2. The case of the petitioner is that the petitioner's father had purchased the aforesaid land and after the demise of his father, the house site is under the possession and enjoyment of the petitioner and his brother. Further, there are two transformers running across the said land without the permission of the petitioner's father, which is a violation of Section 12(2) of the Indian Electricity Act, 2003. According to the petitioner, the transformer running across his land is causing hindrance to the construction activity and further, the two transformers are highly hazardous as it often produce alarming sounds with electric sparks posing a serious risk for the children in the house. In this regard, the petitioner submitted a representation to the respondents dated 09.12.2024 through registered post and though it was received by the respondents, no action has been taken so far and hence, he has filed the instant writ petition.

3. Heard the learned counsel on both sides and perused the materials.

Considering the limited scope of prayer, this Court, without expressing anything on merits, directs the second respondent to consider the petitioner's representation dated 09.12.2024 and after affording opportunity to the parties concerned, shall pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
