Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's representation dated 20.04.2024 and 24.04.2024 for removal of the unauthorized construction and encroachment made by the 5th respondent in the property door no 6/16, Pillaiyar Koil Street, Sivasankaran Nagar, comprised in S.No.322/8 and 322/9 situated in Pozhichalur village, Pallavaram, Pallavaram Firkha and Taluk. ORDER
(Order of the Court was made by S.S.SUNDAR,J.) Despite notice having been served on the private respondent and his name is printed in the causelist, there is no representation for the private respondent.
2. The petitioner though asks for a positive direction to remove the
unauthorized construction and the encroachment made by the fifth respondent, the petitioner's counsel states that the petitioner will be satisfied if a direction is issued to the respondents 1 to 4 to consider the petitioner's representation dated 20.04.2024 alleging that the fifth respondent had put up unauthorized construction.
3. Having regard to the limited scope of the prayer that is now sought before this Court by the petitioner, without expressing any opinion on the merits of the petitioner's contentions in the affidavit filed in support of the petition, the respondents 1 to 4 are directed to consider the representations of the petitioner dated 20.04.2024 and 24.04.2024 and pass appropriate orders in accordance with law, after holding enquiry and hearing the fifth respondent, within a period of twelve weeks from the date of receipt of a copy of this order.
