ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 379, 430 of IPC r/w 21(1) of Mines and Minerals (Development & Regulation) Act in Crime No.87 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with other accused persons were involved in illegal transportation of 10 units of river sand by using two lorries without obtaining proper licence. Hence, the complaint.
3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he has prayed for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) submits that this court has already dismissed the petition in Crl.OP.No.12522 of 2021 dated 22.07.2021 filed by the petitioner. This court perused its careful consideration to the submissions advanced by the learned counsel on either side and already this court has not inclined to grant anticipatory bail vide order dated 22.07.2021 in Crl.OP.No.12522 of 2021 and now this court is seen that no change of circumstances are prevailing in this case. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 18/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
