ORDER

The petitioners apprehend arrest for the alleged offence under Sections 296(b), 132 & 351(2) of BNS, in Crime No.82 of 2026 on the file of the

respondent police seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners asked mamool from the Tasmac shop. Hence, the complaint.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. He further submitted that they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the second petitioner is involved in two previous cases and if anticipatory bail is granted, it will send a wrong signal to the society. Therefore, he opposed the petition.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and also taking note of the fact that there are two previous cases pending against the second petitioner and if anticipatory bail is granted, there is every likelihood that the

petitioners would commit similar kind of offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
