Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Declaration, declaring that the allotment of 875 sq. metres of land to the third respondent which has already been allotted to the petitioner and which is under the possession and enjoyment of the petitioner situated in R.S.No.111/2 Pt behind the shed No.D1 allotted to the petitioner at Mettupalayam Industrial Estate, Pondicherry is illegal and invalid and consequently to direct the second respondent to execute the lease agreement in respect of the above property which has already been allotted to the petitioner provisionally.

ORDER

Heard Mr.V.Ajayakumar, learned counsel appearing for the petitioner and Mr.R.Nandakumar, learned counsel appearing on behalf of the 2nd respondent.

2. When the matter was called, the writ petitioner and the third respondent, the contesting parties, are present. It is stated that they have entered into a compromise and had settled the matter amicably amongst them.

3. Evidencing the compromise, a Trite Party/Joint Compromise Memo was filed before this court. The contesting parties have confirmed that they have affixed their signature and orders be passed on the basis of the said Compromise Memo.

4. The second respondent has also affixed his signature in the Compromise Memo. The said Compromise Memo is taken on record and the writ petition is ordered as per the terms reduced in writing in the Joint Compromise Memo, filed by the petitioner and the respondents 2 and 3.
