.. Respondents This Writ Petition is filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus forbearing the 3rd respondent from the construction of common toilet in petitioners property pursuant to the representation dated 20.08.2015.

The Petitioner seeks for a direction to forbear the third respondent from constructing a common toilet in the petitioner's property.

2. The learned counsel appearing for the respondents raises two contentions. Firstly that the toilet has been constructed pursuant to work order dated 31.7.2015 under a scheme which has been floated for preventing open defecation. Further, a copy of FMB sketch is produced in which the alleged toilet appears to be far away from the inhabited zone.

3. In the light of the above, the writ petition is closed. Consequently, connected miscellaneous petition is closed. No costs.
