Respondent Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent police to give necessary police protection to erecting the wire fencing land comprised in Old S.No.499/1A and New S.No.461/2 at Thuneri revenue Village, and consider the complaint dated 14.05.2019 addressed to the respondent.

O R D E R

This petition has been filed seeking for police protection in order to enable the petitioner from putting up wire fencing around the property.

2. Admittedly, there is a Civil Suit pending between the parties in O.S.No.35 of 2019 and the petitioner has already obtained an order of Interim Injunction against the counter party. If there is any violation of the interim order or the petitioner requires police protection in order to safeguard his rights, the petitioner has to necessarily approach the same Civil Court and seeking for the relief. An independent petition before this Court under Section 482 of Cr.P.C. is not maintainable.

3.This Criminal Original Petition is disposed of by granting liberty to the petitioner to approach the Civil Court where the suit is pending and seek for necessary reliefs and workout his remedy in accordance with law.
