Accepting the reasons assigned in the affidavit file in support of this application, this application is allowed, the exparte order dated 24.01.2018 passed against the defendants 1, 6 to 8 is set aside.

2.The defendants 1, 6 to 8 have filed a memo, adopting the written statement filed by the defendants 2 and 3.

3.Now that the pleadings are complete both in the transferred suit as well as the Testamentary Original Suit, counsel to file draft issues by 06.08.2021.
