Prayer:Writ petition filed under Article 226 of the Constitution of India for issuance of a writ of mandamus to direct the respondents to issue the patta in the name of the petitioner about 1200 sq.ft. area vacant site in No.194, Survey No.123/1, Patta No.461, Sudharshan Nagar-2, Thirumullaivoyal -1 Village, Avadi Municipality area, Avadi Taluk, Thiruvallur District and pass orders on his petitioner's representation dated 14.12.2017 with regard to measuring and demarking, lay stones in the petitioner's land within stipulated period of time as fixed by this Court.

Mr.D.Suriya Naryanan, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a mandamus directing the respondents to consider his representation dated 14.12.2017, wherein and whereby he sought for granting of patta in his favour, after surveying the subject matter land.

4. The grievance of the petitioner before this Court, is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the third respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the third respondent to consider the representation of the petitioner dated 14.12.2017 and pass orders on the same on merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as the rival claimants, if any. Such exercise shall be done by the third respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs. The connected miscellaneous petition is closed.
