O R D E R
The petitioner is the president of Paiyur Village Panchayat, Kaveripattanam Union, Krishnagiri District. The third respondent R.Selvam is the Vice President. The petitioner contends that he is unable to function properly and discharge his function as President as the third respondent is not co-operating with the petitioner and the village panchayat works have come to a stand still. Therefore, the petitioner gave representation to the first respondent on 01.09.2015 to take action against the third respondent, https://hcservices.ecourts.gov.in/hcservices/
Vice President. Since the said representation has not been disposed of, the petitioner is before this court.
2. Mr.R.Lakshmi Narayanan, learned Additional Government Pleader takes notice for the first and second respondent. No notice is necessary to the third respondent since this court only directs the first respondent to dispose of the representation of the petitioner, after giving opportunity to the third respondent.
3. The petitioner contends that he could not function effectively as a Village Panchayat President as the third respondent Vice President is not co-operating and his co-operation in encashng the cheques is required as he is the co-signor to the cheques of the Panchayat and that the village works have come to a stand still. Therefore, it is appropriate to direct the first respondent to conduct an enquiry and pass orders on the petitioner's representation dated 01.09.2015, after giving notice to the third respondent and after hearing him. Without hearing the third respondent, no order should be passed. The first respondent is directed to dispose of the representation of the petitioner within a period of four weeks from the date of receipt of a copy of this order.
4. With the above direction, the writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
