Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the order dt.25.09.2017 in Na.Ka.No.23794/E2/2017 passed by the 1st respondent and received by the petitioner on 12.10.2017, quash the same and consequently direct the 2nd respondent to return forthwith his original driving license bearing No.TN-21 19970002049, without any endorsement and within a specified time. O R D E R

Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner is aggrieved by the order suspending the https://hcservices.ecourts.gov.in/hcservices/

driving licence of the petitioner for six months commencing from 25.09.2017.

3. Admittedly, as against the said order, the petitioner is having an alternative remedy of filing an appeal before the Joint Transport Commissioner, Chennai. Therefore, it is for the petitioner to file such an appeal before the concerned Appellate Authority and agitate the same. Accordingly, this writ petition is disposed of, without expressing any view on the merits of the matter, only granting liberty to the petitioner to file such an appeal, within a period of two weeks from the date of receipt of a copy of this order. If any such appeal is filed, the Appellate Authority shall consider the appeal on its own merits and in accordance with law, after giving due opportunity of hearing to the petitioner, within a period of four weeks from the date of filing of the appeal. No costs. Consequently, connected miscellaneous petition is closed.
