PRAYER: This criminal original petition has been filed under Section 483(1)(b) of BNSS Act, 2023, to modify the bail condition "6(b) the petitioner shall deposit a sum of Rs.4,00,000/- (Rupees Four Lakhs only) to the credit of Cr.No.104 of 2025 within 15 days from the date of his release in Crl.M.P.No.2762 of 2025 dated 02.04.2025 made in Cr.No.104 of 2025 and extend the time for making the deposit in the bail order in Crl.M.P.No.2762 of 2025 dated 02.04.2025 made in Cr.No.104 of 2025 on the file of the learned Principal Sessions Judge, Chennai. The petitioner seeks modification of the condition to deposit Rs.4,00,000/- (Rupees Four Lakhs only) in Crime No.104 of 2025 imposed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.2762 of 2025 dated 02.04.2025.
2. The learned counsel for the petitioner/A2 would submit that the condition is onerous and in any case, in the event of this Court upholding the said condition, he may be granted time to make the deposit.
3. Heard the learned Government Advocate (Crl.Side) for the respondent.
4. It is seen from the order dated 02.04.2025 that the learned counsel for the petitioner had offered to deposit the money and therefore, the learned Judge had directed him to deposit the money. Hence, the said condition cannot be set aside. However, the petitioner is granted four weeks time to make the deposit from today.
