Prayer : - Writ Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 2nd respondent to dispose of the petitioner's representation dated 08.03.2021 to initiate enquiry against the Village Administrative Officer, Moongilthangal Village, Arani Taluk, Thiruvannamalai District on the basis of the direction of the Revenue Divisional Officer, Arni, Thiruvannamalai District dated 24.05.2021.
For Petitioner :
Mr.R.Karunagaran For RR 1 to 3 :
Mr.Yogesh Kannadasan Government Advocate
ORDER
(1) Mr.Yogesh Kannadasan, learned Government Advocate accepts notice on behalf of the respondents 1 to 3.
(2) The writ petition has been filed in the nature of a mandamus to intiate enquiry against the Village Administrative Officer, Moongilthangal Village, Arani Taluk, Tiruvannamalai District, apparently on the basis of https://hcservices.ecourts.gov.in/hcservices/
a direction of the Revenue Divisional Officer, Arni, Thiruvannamalai District dated 24.05.2021.
(3) I am afraid that such a mandamus cannot be given as rightly pointed out by the learned Government Advocate that there is no such direction given by the Revenue Divisional Officer, Arni. On the other hand, the Revenue Divisional Officer, Arni, had only forwarded the petitioner's representation to the jurisdictional Revenue Divisional Officer, viz., the Revenue Divisional Officer, Cheyyar Taluk and there has been no such direction given. It is only a forwarding of the letter.
(4) It would only be appropriate if the petitioner herein gives some time to the Revenue Divisional Officer, Cheyyar Taluk, to examine the representation and to thereafter, pass appropriate orders. The writ petition at this stage, has been filed with not only an incorrect relief sought, but also is premature. The order passed in this writ petition will not preclude the writ petitioner from approaching this Court again.
(5) The writ petition stands dismissed with the above observations.
No costs.
Consequently, connected miscellaneous petition is closed.
