) This miscellaneous petition has been filed seeking to condone the delay of 95 days in paying the Deficit Court fee of Rs.28,651/- in the appeal, in C.M.A. (SR) No.66138 of 2016.

2. Heard the learned counsel appearing on behalf of the petitioner.

In view of the submissions made by the learned counsel appearing for the petitioner and in view of the averments made in the affidavit filed in support of the miscellaneous petition, this petition is allowed and the delay of 95 days in paying the Deficit Court fee of Rs.28,651/- in the appeal is condoned.

Registry is directed to number the Civil Miscellaneous Appeal and list the same for admission.
