This petition has been filed seeking a direction directing the respondents not to harass these petitioners in the guise of enquiry.

2. The learned counsel for the petitioners would submit that already there is a civil suit pending between the petitioners and the defacto complainant. However, the defacto complainant has given the complaint dated 04.05.2019, for which C.S.R.No.40 of 2015 was issued. Thereafter, the petitioner was summoned for enquiry. Now the petitioner is claiming that the respondent police were made aware of the pendency of civil suit, however he is unnecessarily harassed.

3. The learned Government Advocate appearing for the respondent police would submit that enquiry is to be conducted soon, and if enquiry reveals about the cognizable offence, case would be proceeded with, otherwise the case would be dropped.

4. Considering the submission of the learned Government Advocate, it is made clear that if at all the petitioner is needed for enquiry, proper notice to be sent by the respondent Police for conducting enquiry.

5.With the above observation, this Criminal Original Petition is closed.
