The present Criminal Original Petition has been filed seeking a direction to the respondent to register a case on the petitioner's complaint dated 27.07.2015 and investigate the same in accordance with law.

It is the case of the petitioner that on 19.07.2015, one Sivakumar, S/o.Late Munusamy Reddy along with some unknown rowdy elements entered into the petitioner's property and removed all the boundary stones, destroyed the ridges and also attempted to fence the property illegally. When the petitioner rushed to the spot immediately and questioned the illegal acts of the said culprits, they threatened the petitioner with dire consequences. Hence, the petitioner made a complaint to the respondent police on 27.07.2015 and CSR was issued to the said complaint on the same day. As no action was taken on the said complaint, the petitioner, having no other alternative, has come up with the present Criminal Original petition.

Learned Additional Public Prosecutor appearing for the respondent would submit that C.S.R. has been assigned to the petitioner's complaint vide C.S.R.No.148/2015 and the matter is pending for enquiry.

Considering the submissions made on either side, this Court is of the opinion that it is appropriate to direct the respondent to conduct an enquiry on the petitioner's complaint dated 27.07.2015, if enquiry is not conducted so far, and proceed further in accordance with law, as early as possible.
