ORDER
This writ petition has been filed seeking to direct the respondent to conduct survey on the petitioner's land situated in Survey No.154/6B to an extent of 1 Acre 93(78 Ares) cents and the land to an extent of 40 cents (16 Ares) in Survey No.154/7 of Athimugam Village, Hosur-Taluk (Presently Soolagiri -Taluk) Krishnagiri District as per the online application No.2025/0123/31/014487 dated 7.10.2025 and based on the representation dated 8.10.2025.
2.Learned counsel for the petitioner made an online application dated 07.10.2025 and a representation dated 08.10.2025 before the respondent seeking to survey and demarcate the properties morefully described in the prayer to this writ petition. Since the same was not considered by the respondent, the present writ petition has been filed.
3.Mr.M.Guruprasad, learned Government's Counsel, who accepts notice on behalf of the respondent would submit that the petitioner's application dated 07.10.2025 and a representation dated 08.10.2025 will be considered and disposed of within a time frame to be fixed by this Court.
4.Heard the learned counsel for the petitioner as well as the learned Government's Counsel appearing for the respondent. 5.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondent to consider the petitioner's online application dated 07.10.2025 and a representation dated 08.10.2025, taking into consideration of the fact that the patta was issued on 24.03.2026 in favour of the petitioner for the subject property and conduct a survey and demarcate the subject properties, within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner and other parties concerned, if any.
If any need arises for Police assistance, it is open to the respondent to request for Police protection from the jurisdictional Police. If any such request is made, the jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 6.It is made clear that this order is passed only for the purpose of issuing a direction to the respondent to conduct survey and to demarcate the subject properties. In the event any dispute arises regarding the possession of the subject properties, the same has to be decided by way of filing a suit before the competent Civil Court.
