Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to promote the petitioner to the post of Deputy Superintendent of Police by including the name of the petitioner in appropriate place in the panel for the year 2012-2013 with all consequentlial and other attendant benefits within a time frame to be fixed by this Court.

The case of the petitioner is that his promotion was withheld on account of currency of punishment.
2. According to the petitioner, the punishment period has expired and as such, he should have been considered for promotion by including his name in the panel for the year 2012-2013.
3. Since the respondents failed to include the name of the petitioner for promotion, he is before this Court. https://hcservices.ecourts.gov.in/hcservices/
4. Heard, Mr.G.Sankaran, learned counsel appearing for the petitioner and Mr.A.Kumar, learned Special Government Pleader, appearing for the respondents.
5. The question as to whether the name of the petitioner should be included in the panel for promotion to the post of Deputy Superintendent of Police, is to be decided by the second respondent.
6. The petitioner is given liberty to submit a representation to the second respondent for the purpose of including his name in the panel for promotion. In case, any such representation is received, the same shall be considered and disposed of by the second respondent, in the light of the Government Letter No.49368/Pol3/2012-4, dated 07.03.2013 and on merits and in accordance with law. Such exercise shall be completed within a period of three months from the date of receipt of representation.
7. The Writ Petition is disposed of with the above direction. No costs.
