PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus seeking direction towards the respondents 1 to 3 to dispose of the petitioner's representation dated 19.02.2025 within a stipulated time frame by giving opportunity to the petitioner.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents 1 to 3 to consider and dispose of the petitioner's representation dated 19.02.2025, after affording the petitioner an opportunity of hearing.

2. Heard both sides and perused the materials available on record.

3. On perusal of the representation submitted by the petitioner dated 19.02.2025 reveals that the petitioner has raised objections to the

manner in which 174 miscellaneous petitions have allegedly been filed by a single advocate representing multiple accused persons, purportedly at the instance of the fourth respondent. The petitioner contends that such action casts doubt on the impartiality of the proceedings and seeks appropriate action to be taken as against the fourth respondent. However, this Court is of the considered view that there is no legal bar on a single advocate representing multiple accused or petitioners in separate or connected matters, so long as such representation is not in violation of any ethical or procedural norms. The mere filing of multiple miscellaneous petitions through one counsel, without any concrete allegation of coercion, impropriety, or procedural misconduct, does not amount to misconduct or abuse of process, nor does it give rise to a cause of action warranting intervention by this Court under Article 226 of the Constitution of India.

4. Moreover, no material has been placed before this Court to demonstrate that the fourth respondent exercised any undue influence or interfered with the legal rights of the accused or the conduct of judicial

proceedings. In the absence of such substantiated allegations, the petitioner's representation cannot be acted upon.

5. In view of the above, this Court finds no merit in the relief sought by the petitioner. The Writ Petition stands dismissed. There shall be no order as to costs.
