ORDER

The present criminal original petition has been filed seeking a direction to the second respondent to register a case based on the complaint dated 16.8.2015 and investigate the same in accordance with law.

2. It is the case of the petitioner that she has lodged a complaint with the second respondent police on 16.8.2015 as against one Anitha stating that the said Anitha and her husband have forcibly taken away the petitioner's gold jewels worth about 200 sovereigns. Though the said complaint was given on 16.8.2015, till date, no action has been taken on the said complaint. Hence, the petition.

3. Learned Additional Public Prosecutor submitted that the said Anitha is none other than the daughter of the first wife of the petitioner's husband. The dispute between the parties is personal in nature and absolutely, no cognizable office is made out in the said complaint. Thus, he opposed to give a direction to the second respondent police to register a case.

4. Keeping the submissions made on either side, I have carefully gone through the entire materials available on record and as contended by the learned Additional Public Prosecutor, I do not find any valid reason to give a direction to the second respondent to conduct enquiry on the complaint given by the petitioner. Hence, the criminal original petition is dismissed.
