J U D G M E N T

Today, i.e., on 01.03.2018, both the appellants and the respondent as well as their respective counsels are present and they have filed a memorandum of compromise entered into between them, signed by both the parties as well as the respective counsels.

2.Terms of compromise read over to the parties and they admitted the same to be correct. In terms of the compromise, the judgment and decree dated 30.07.2001 passed in O.S.No.721 of 1996 on the file of Subordinate Court, Bhavani, confirmed by the judgment and decree dated 12.04.2004 passed in O.S.No.186 https://hcservices.ecourts.gov.in/hcservices/

of 2001 on the file of Principal District Court, Erode for specific performance are set aside and instead, the respondent is granted a money decree for the sum of Rs.1,95,000/- (Rupees One lakh, ninety five thousand only) which has been admitted to be received by the respondent as per the terms of the compromise. 3.Accordingly, the second appeal is disposed of. Consequently, connected miscellaneous petition, if any, is closed.

4.The memorandum of compromise filed by the respective parties and the counsels today and recorded by this Court shall form part of the decree passed in the second appeal. 5.Registry is directed to communicate the copy of this Order to the Office of the Sub Registrar,Anthiyur, for further necessary action.
