The present criminal original petition has been filed seeking direction to the respondent to register an F.I.R on petitioner's complaint dated 07.11.2015 and for proper investigation.

2.The petitioner who belonged to S.C. Community got married to one Subashri on 25.06.2009 and led a peaceful life as husband and wife for the past 5 years. Thereafter Subashri got married one Sivakumar on 17.09.2015 with the help of one Mariappan and their marriage was registered on 21.09.2015 in SubRegistrar,Jalagandapuram. When the petitioner came to know about the second marriage of his wife, he quarrelled with the said Sivakumar. The said sivakumar threatened to kill the petitioner. Hence, the petitioner lodged a complaint on 07.11.2015. But, till date, no action was taken on the said complaint. Hence, the present Criminal Original Petition has been filed.

3. Today, when the matter is taken up for consideration, learned Additional Public Prosecutor submitted that the allegation does not constitute any cognizable offence. https://hcservices.ecourts.gov.in/hcservices/

4. Recording the submission of the learned Additional Public Prosecutor is that since the complaint does not disclose commission of cognizable offence, this court cannot give any positive direction and this petition is dismissed. However, the petitioner is at liberty to work out his remedy in the manner known to law, if he so desires.
