The present criminal original petition has been filed seeking a direction to the respondents to register the FIR based on the complaint dated 16.10.2015 given by the petitioner, pending under CSR.No.558 of 2015, on the file of the 2nd respondent police.

2. The petitioner lodged a complaint on 16.10.2015 against one G.Parthasarathy and M.Ganesan for the offences under sections 506 (ii), 447, 420 and under Section 3 of the Prevention of damage to public Property Act, 1984 and the same was registered by the respondent police in C.S.R.No.558 of 2015. But, till date, no enquiry was conducted and FIR was registered by the respondent police. 3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. Considering the submissions made on either side, this Court directs the second respondent to conduct an enquiry on the complaint dated 16.10.2015 given by the petitioner and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.
