J U D G M E N T

(Judgment of the Court was delivered by S.M.SUBRAMANIAM, J.) The present intra-Court appeal has been instituted to assail the writ order dated 20.01.2025 made in W.P.No.25290 of 2024. 2/6

2. The writ petitioner is the appellant before this Court. Writ Petition has been instituted seeking direction to respondents 1 to 5 to take befitting action in terms of the Registration Act and the Transfer of Property Act against (1) the power agent by name M.Seenu @ Natarajan and his legal heirs (2) the document writer by name C.Siva @ Sivasankaran License No.280, No.72, Perumal Koil Street, Puducherry and (3) the Sub-Registrar, Puducherry, who registered the same and to cancel sale deed No.3837 of 2004 dated 01.09.2004 and the subsequent registered document also.

3. Writ Court considered the nature of relief sought for, the scope of adjudication of civil rights and consequently dismissed the Writ Petition. To reiterate the principles, disputed facts cannot be adjudicated by Writ Court under Article 226 of the Constitution of India. Civil rights are to be established before competent civil Court in the manner known to law. The relief sought for in Writ Petition is not entertainable, since it involves adjudication of civil rights between parties.

4. Thus, this Court does not find any infirmity or perversity in respect of the findings and the decision made by the writ Court. Consequently, present Writ Appeal stands dismissed. However, in the event of instituting any civil suit, the civil Court has to consider the issues independently based on the documents and evidence and uninfluenced by any of the observations made 3/6

by writ Court on facts. No costs. Consequently, the connected miscellaneous petition is closed.
