O R D E R

The present criminal original petition has been filed seeking a direction to the respondent Police herein to investigate the case in Crime No.1449 of 2014 dated 01.11.2014 on his file and file the final report before the competent Court within the stipulated period.

2. The petitioner herein lodged a complaint as against one Suresh, Radhakrishnan @ Radha and Jayanthi for the alleged offence under sections 294(b), 323, 32, 506(ii) IPC r/w Section 4 of Tamilnadu Women Harassment Act with the respondent police in Crime No.1449/2014. Though the complaint was lodged as early as on 1.11.2014, till date, there is no progress in the investigation. The respondent police are not investigating the matter for the reason best known to them. Hence, he has come https://hcservices.ecourts.gov.in/hcservices/

forward with the present petition to direct the respondent police to investigate the case in Crime No.1449/2014 and file a final report before the competent Court within a specified period.

3. When the matter is taken up for consideration learned Additional Public Prosecutor submitted that the investigation has been completed and the charge sheet is ready. Since the petitiner is not co-operating with the respondent police in obtaining the certificate from the doctor, the charge sheet has not been filed. He further submitted that the petitioner has to go and meet the concerned doctor to get the necessary certificate. If the petitioner co-operates with the respondent police in obtaining the certificate from the doctor, the respondent police would file the charge sheet within a short span of time.

4. Learned counsel for the petitioner submitted that the petitioner is always ready to co-operate with the respondent police.

5. In view of the submission made by the learned Additional Public Prosecutor, the petitioner is directed to co-operate with the respondent police in obtaining the doctor certificate. On receipt of such certificate, the respondent police is directed to file the charge sheet before the competent Court. The entire process shall be completed within a period of one month from today. The criminal original petition is disposed of accordingly.
