O R D E R
The present criminal original petition has been filed seeking direction to the second respondent police to register the case and investigate the same according to law on the complaint given by the petitioner on 16.11.2015 against the accused persons.
2. The petitioner herein lodged a complaint on 16.11.2015 against one Rajendran and Gunasekar, alleging that the revenue documents which belonged to the petitioner was forged in a fraudulent manner. It is submitted by the petitioner that since the second respondent police refused to accept the said complaint given by the petitioner, the petitioner had sent the same through registered post. The same was acknowledged by the respondents, but, no action was taken till date.
3. The learned Additional Public Prosecutor submitted that the complaint was sent only by post and as on date, no complaint has been pending before the second respondent police. It is further submitted that if a direction is given to the petitioner to give a fresh complaint, necessary action will be taken.
4. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
5. In view of the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the second respondent within a period of one week from the date of receipt of a copy of this order, and on receipt of the same, the second respondent is directed to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.
6. This criminal original petition is disposed of accordingly.
