ORDER
The present criminal original petition has been filed to modify the order from local sureties into any other sureties belongs to accused's own state in the order dated 30.6.2015 made in Crl.M.P.No.1639 of 2015 on the file of the learned Principal Sessions Judge of Kancheepuram District at Chengalpattu.
2. It is the case of the petitioners that the learned Principal Sessions Judge, Kancheepuram while granting bail to these petitioners, based on their undertaking, imposed a condition that the petitioners should produce local sureties to the satisfaction of learned Judicial Magistrate at Alandur and after satisfying the genuineness of the same by the learned Magistrate, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- each with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Now, the present petition has been filed to modify the said condition stating that the petitioners are not able to produce local sureties. https://hcservices.ecourts.gov.in/hcservices/
3. Learned Additional Public Prosecutor submitted that since the petitioners belong to West Bengal, based on the undertaking given by the petitioners that they are ready to produce local sureties if they are granted bail, the said condition was imposed by the learned Principal District and sessions Judge, Kancheepuram. Thus, he opposed to modify the condition.
4. In view of the submission made by the learned Additional Public Prosecutor, I do not find any valid reason to modify the said condition imposed by the learned Principal sessions Judge, Kancheepuram District at Chengalpattu and hence, the criminal original petition is dismissed.
