The petitioner, who apprehends arrest for the alleged offences under Sections 323 of I.P.C and Section 75 of the Juvenile Justice (Care and Protection of Children Act, 2015, in Crime No.223 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant viz., Nishanthini, who is a Child Welfare Officer has given a complaint against the petitioner alleging that the petitioner who is the step mother has beaten the victim child by name Yashwin aged 4 years, and illtreated him. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way

connected with the alleged offence. He further submitted that the petitioner has also filed a petition seeking anticipatory bail before the learned Principal District and Sessions Judge at Tiruvallur in Crl.M.P.No.1508 of 2023 and the same was dismissed on 26.04.2023. Hence, he prayed for grant of anticipatory bail to the petitioner.

The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner is the step mother of the victim child and she has beaten the said child who is aged about 4 years with hands and thereby the victim child sustained grievous injuries all over the body. Hence, he opposed for granting anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Considering the serious nature of the offence committed by the petitioner, this Court is not inclined to grant Anticipatory Bail to the petitioner. Accordingly, this Petition is dismissed. 10.05.2023 vum/dna
