For Petitioner : Mr.A.M.Natraj (in all contempt petitions) For Respondents : Mr.Vijayakumari Natarajan (in all contempt petitions) C O M M O N O R D E R These Contempt Petitions have been filed on the ground that the orders of this Court dated 02.03.2021 passed in W.P.No.18673 of 2020 and 18074 of 2020 have not been complied with.

The learned counsel appearing for the Petitioners submitted that as the petitioners have got equivalence certificate, they should have been given preference over others who were called for interview pursuant to the call letter dated 21.04.2021. Since the Respondents have violated the orders of this Court, it amounts to wilful disobedience of the orders of this Court and accordingly, they are liable to be punished.
3. Today, when the matters were taken up for hearing, pursuant to the 3/6
order dated 13.06.2023 passed by this Court in Contempt Petition Nos.1183 and 1199 of 2022, the Respondents herein viz., Thiru.R.Kannan, Member Secretary, Tamilnadu Pollution Control Board, Chennai and Dr.M.Jayanthi, I.F.S., Chairman, Tamil Nadu Pollution Control Board, appeared before this Court through Video Conferencing. They submitted that the order dated 02.03.2021 was received by them on 27.04.2021, by which time, call letters had been sent to other candidates on 23.04.2021 and selection also had taken place. They further submitted that they are willing to consider the case of 13 candidates, who are the petitioners in these contempt petitions without conducting any written examination and by conducting interview alone and taking into account the Equivalence Certificate, they will be selected and appointed.

While so, it was brought to the attention of this Court by the learned counsel for the Petitioners that there are already five vacancies, as has been stated under the RTI Act by the Tamil Nadu Pollution Control Board. In case, these vacancies are to be filled up, nothing can prevent the Respondents from calling the petitioners to attend interview. 4/6
5. In view of the oral submission made by the respondents in paragraph 3, supra, to the effect that the petitioners will be called for interview as and when vacancy arises and depending upon their performance in the interview, they will be accommodated in the respective position, these contempt petitions stand closed. 14.07.2023 arr 5/6
