..Respondents Petition filed under Article 226 of The Constitution of India praying to issue a writ of certiorarified mandamus to call for the records of the first respondent dated 24.12.2013 in letter No.46930/ECA1/2013 and the consequential proceedings, quash the same in so far it directs the second respondent to withhold the result of the petitioner and consequently, direct the respondents to approve the admission of the petitioner vide application No.120456 in B.Arch Degree Course 2013.

ORDER

The petitioner is one among the students admitted in the first year B.Arch Degree Course, in the college, by name, McGan's Ooty School of Architecture, Perar, Kothagiri, The Nilgiris. By the impugned proceedings dated 24.12.2013, the first respondent has informed the Principal of the College that though there is an order in favour of the persons, who were similarly placed, in W.P.No.16170 of 2012 in which this Court held that the subject of Business Mathematics is equivalent to Maths, in view of the review petition filed, the permission granted to write the examination is conditional and the same cannot be treated as approval. Challenging the same, the present writ petition has been filed.

It appears that even as on today, no review application is taken on file. Considering the same issue, the Division Bench of this Court has also passed similar orders in favour of the persons similarly placed as that of the petitioner. The Division Bench in W.P.No.18515 of 2013, by an order dated 01.10.2013, taken note of the earlier order dated 03.09.2012 passed in W.P.No.16170 of 2012 and held that the order passed in the said writ petition is squarely applicable to the case on hand. Thus, even the review application has become irrelevant as per the order passed by this Court. 3.

Accordingly, the order impugned is set aside and the writ petition is allowed. Consequently, a direction is issued to the respondents to publish the result of the petitioner and approve the admission within a period of eight weeks from the date of receipt of a copy of this order. No costs.

Consequently, connected miscellaneous petitions are closed.
