ORDER

This writ petition has been filed seeking to declare that the respondents insisting on patta for government land exempted under ULC as a prerequisite for issuance of "D" Form License is illegal and consequentially to direct the respondents to issue "D" Form License to the petitioner organisation for running home for Mentally disabled persons at No.5, Subbarayan Main Street, Pumping Station Road (Opp Government Polytechnic College) Nammalwarpet, Otteri, Purasawakkam, Chennai - 600 012.

2.Learned counsel for the petitioner would submit that the petitioner organisation is providing care for the people with mental illness wandering on the streets. The petitioner organisation after rescuing people with mental illness from the streets provide them holistic medical support to assist in their recovery. He would further submit that the premises which is being run by the petitioner was Government acquired excess land under the Urban Land Ceiling and

Regulation Act. The said land was originally allotted to one M/s.Guild of Services [Central], a publicly known social service organisation. The petitioner organisation has taken the aforesaid premises on lease from the said M/s.Guild of Services [Central] and has built up a construction for running home for mentally ill persons and obtained a "D" Form license from the Sub-Collector, Tondiarpet, Chennai on 17.07.2015 and 12.09.2017. Under such circumstances, the petitioner applied for renewal of license under Section 6(1) of the Tamil Nadu Building [Licensing] Act, 1965 before the 2nd respondent in the year 2020. However, the 2nd respondent is insisting the petitioner to produce patta in respect of the subject premises for issuance of "D" Form license. 3.

He would further submit that since the petitioner organisation is a lessee of the said premises they are not in a position to produce patta in respect of the subject premises and hence seeks for a direction to the 2nd respondent to issue "D" Form license without insisting upon patta as granted earlier by the SubCollector. 4.Learned Additional Government Pleader appearing for the respondents would submit that subsequent to the filing of this writ petition, the 2nd respondent had issued the "D" Form licenses for the subject premises for running a home for mentally disabled persons and therefore, the petitioner shall withdraw this writ petition.

5.In reply, learned counsel for the petitioner would submit that the petitioner apprehends that the 2nd respondent may insist on a patta when the petitioner seeks renewal of the "D" Form license in the future. Therefore, he prayed this Court for a direction to the 2nd respondent not to insist on a patta during the future renewals of the "D" Form license. 6.Considering the submissions made by both parties, it is evident that the prayer sought for in this writ petition has been achieved. However, this Court directs the 2nd respondent to consider the petitioner's application for renewal of the "D" Form without insisting on a patta in respect of the subject premises in future.
