ORDER

The criminal original petition has been filed to direct the learned District and Sessions Judge (PD Court), Ranipet to consider the bail application of the petitioners on the same day of their surrender in Crime No.71 of 2026, on the file of the Inspector of Police, Thimiri Police Station, Ranipet District/2nd Respondent.

2. Heard the learned counsel appearing for the petitioners as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3. Considering the submissions made and upon perusal of the materials available on record, it is seen that the de facto complainant is running a waste paper mart. In order to expand his business, he had taken a shop on a monthly rent of Rs.10,000/-. On 25.03.2026, at about 12.00 p.m., while he was cutting a

branch of a tree that was causing obstruction to the proposed shop premises, the petitioners allegedly took photographs of the shop. When the de facto complainant questioned the same, the petitioners are alleged to have abused him in filthy language, referring to his caste name, and further assaulted him. Subsequently, the de facto complainant approached the second respondent police, who registered a First Information Report in Crime No.71 of 2026 for the alleged offences under Sections 329(3), 296(b), and 115(2) of the Bharatiya Nyaya Sanhita (BNS), as well as Sections 3(1)(r), 3(1)(s), and 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The learned counsel for the petitioners submitted that the petitioners and the landlord of the de facto complainant have been involved in a land dispute, and that, in order to avenge the said dispute, the present complaint has been filed. 4.In view of the above factual position, there shall be a direction to the the District and Sessions Judge (PD Court), Ranipet, to consider the petitioners' bail application, preferably on the same day of his surrender, in connection with Crime No.71 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989.
