This Civil Miscellaneous Petition has been filed to condone the delay of 236 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Ms.R.P.Usha, learned counsel would submit that Mr.D.Venkatachalam, undertakes to file vakalat for the second respondent and he does not have serious objection in allowing this petition.

4. The petitioner would aver that on account of the injuries sustained by him, he was not in a position to mobilize funds for preferring the appeal and therefore, delay of 236 days occurred in filing the Civil Miscellaneous Appeal.
