This petition has been filed to implead the petitioner/proposed respondent as respondent in the above Crl.O.P.No.12466 of 2021. 2.The learned counsel appearing for the petitioner/proposed respondent submitted that the crux of the complaint was that they entered into their land where first respondent i.e. VGP Housing Pvt. Ltd. were illegally in occupation and had vacated them whereas on the same day enquiry was conducted to find out the genuineness of the title and EB records and further on enquiry and perusal of record the police, instructed VGP not to interfere in any illegal manner and advised to approach the civil forum if they hold any right.

3.The learned counsel appearing for the first respondent herein submitted that the petitioner is to be classified as an accused, if the Page No.1/4

respondent police properly acted on their complaint. In view of the same, the impleading petition cannot be heard and objected the same. 4.Considering the submissions on both sides and on perusal, this Court is of the opinion that the case is only at the stage of CSR and the CSR number is 404/2021, which is in the nature of complaint and counter complaint. Hence, this Court is inclined to allow this miscellaneous petition to implead the petitioner/proposed respondent as second respondent in Crl.O.P.No.12466 of 2021.

5.Accordingly, this Criminal Miscellaneous Petition is ordered. Registry is directed to carry out necessary amendment in the papers. 6.In the mean time the respondent police is directed to file status report with regard to the CSR No.404 of 2021 dated 29.06.2021. Page No.2/4
