PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents and in particularly the 1st and 2nd respondents to get information seeking by the petitioner through his representations dated 24.03.2016, 07.04.2016 and 20.09.2016 from the 3rd respondent and furnish the same to the petitioner. The relief sought for in the present writ petition is to direct the respondents and in particularly the respondents 1 and 2 to provide information with reference to the representations submitted by the petitioner on 24.03.2016, 07.04.2016 and 20.09.2016. The letter dated 24.03.2016 is a representation for the purpose of seeking information under the provisions of the Right to Information Act, the petitioner has to follow the procedures and the application must be in a prescribed manner. https://hcservices.ecourts.gov.in/hcservices/
2.Even in case, the Public Information Officer fails to provide information, an appellate remedy also available before the State Information Commission. Based on the mere representation, the relief to provide information in a writ proceedings need not be granted. When the statute provides comprehensive relief for the procedures contemplated under the Act is to be followed for the purpose of getting information from the Public Information Officer.
3.This being the scheme of the Right to Information Act, the petitioner is at liberty to submit a proper application before the Public Information Officer in the prescribed manner enabling the officials to respond to the application in the manner known to law.
4.With these liberty, the writ petition stands disposed of. No costs.
