Prayer: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of Mandamus, directing the 1 to 4 respondents to consider the petitioner's representation dated 04.03.2025 and pay the regular pension, gratuity with interest and commutation of pension within stipulated time as fixed by this Court.

ORDER
This writ petition has been filed to direct the respondents 1 to 4 to consider the petitioner's representation dated 04.03.2025. Learned Counsel for the petitioner would submit that the petitioner was appointed as Assistant Executive Engineer and retired on 30.09.2022. In the meanwhile, there was disciplinary proceedings against the petitioner vide proceedings dated 15.05.2023. Since charge against the petitioner was proved, and punishment was imposed to deduct Rs.1,000/- from his pension every month for a period of one year, the said order was challenged in W.P.No.18468 of 2024, and the writ petition was dismissed on
11.07.2024. However, the writ Court has directed the respondents to pass final orders on the disciplinary proceedings within a period of eight weeks. Subsequently, final order was passed on 18.07.2024 holding the petitioner guilty of all the charges, and ordered to deduct Rs.1,000/- from the petitioner's pension every month for a period of one year. It is the grievance of the petitioner that, in spite of imposing the above punishment and implementing the same, the petitioner is getting only provisional pension and not provided with the regular pension. Learned Counsel for the petitioner would submit that the petitioner has sent a representation on 04.03.2025 seeking regular pension and the same is yet to be considered by the respondents. 5.
Since the representation of the petitioner is still pending with the respondents and the petitioner come up with the limited prayer for consideration of the representation, this Court without going into the merits of the matter, direct the respondents to consider the petitioner's representation dated 04.03.2025 according to its own merits and pass orders in accordance with law within a period of six weeks from the date of receipt of a copy of
this order.
In the result, in view of above direction, the Writ Petition stands disposed of. No costs.
